CBG Legality – Is it Like CBD?

The short answer is yes! CBG is very similar to CBD as far as legality is concerned, but there are some minor differences you my want to be aware of as a consumer. As of 2018, the Agricultural Improvement Act descheduled hemp-derived products. So as long as your CBG is derived from hemp, (as opposed to cannabis containing above .3% THC) it is not scheduled under the UN Convention of Psychotropic Substances. It’s legal!

The major difference between CBD and CBG is the fact that CBG hasn’t been approved as a drug. Because of this, CBG is already being marketed in dietary supplements and food products. Certain parts of the Cannabis plant don’t apply to the FDA’s “drug exclusion rule” and CBG seems to be one of them, making it less scrutinized by the FDA than other cannabinoids. Farmers, producers, and cannabis companies still have to be careful to avoid unapproved health claims, however in general it seems more is legal than not when marketing a CBG product. As a consumer you have to be careful especially in the early stages of CBG production to make sure that you’re getting a quality product with a good reputation. Almost all CBG is expensive, but you don’t always get what you pay for, so being educated is important!

Like with any Cannabis product, law enforcement can sometimes be less educated than the consumer about what’s legal and what isn’t. Treat your CBG like CBD, and always carry lab results and keep your product in it’s original packaging. For some reason, officers have no problem throwing people in jail before testing THC levels in a product, so being respectful and having as much information on hand as possible will help you in a sticky situation.
